Benchmark rents and category rents form the basis for determining the main rent in accordance with the Tenancy Law Act (MRG). The benchmark rent generally applies to standard apartments in older buildings with tenancy agreements dated 1 March 1994 or later. The category rent applies to older apartments with older tenancy agreements, depending on the fixtures and fittings.

To date, the adjusted amounts under the Benchmark Rent Act and the Tenancy Law Act have been published by the Federal Minister of Justice, most recently for the period from 1 April 2023 to 31 March 2026 via Federal Law Gazette II No. 81/2023 and Federal Law Gazette II No. 170/2023. Since 1 April 2026, the values are published by Statistics Austria.

Statistics Austria is solely responsible for publishing the figures. Individual calculations based on tenancy agreements regarding reference values and category amounts are not carried out.

Compiled on 31st March 2026. In accordance with the obligation imposed by Section 5(2) of the Benchmark Rent Act, Federal Law Gazette No. 800/1993, as amended by Federal Law Gazette I No. 114/2025, it is hereby published that the benchmark values specified in Section 5(1) of the Benchmark Rent Act will change with effect from 1 April 2026 as indicated above.

In accordance with the obligation imposed by Section 16(6) of the Tenancy Law Act (MRG), Federal Law Gazette No. 520/1981, as amended by Federal Law Gazette I No. 114/2025, it is hereby published that the provisions set out in Section 16(5), Section 15a(3), Section 18(5), Section 20(1), Section 45(1) and (2) and Section 46(2) of the MRG will increase as stated above with effect from 1 April 2026.
