1. In principle

The ISIS database of STATISTICS AUSTRIA is publicly available; every physical or legal person may apply for a user identification enabling online access to ISIS. Admission to the group of participants is accomplished by a written declaration of acceptance of the application by STATISTICS AUSTRIA.

A registered person may receive user identifications and other services not only for his/her own use but also for third persons (e.g., for clients of a service data centre who are connected through to the ISIS database); on the other hand, he/she is liable for any claims resulting from the registration and made by STATISTICS AUSTRIA.

The user identification must be attributed to (a) person/persons. Where private persons are concerned, not only the name of the person (in charge) but also the respective agency or department or unit etc. should be given; it must be evident, in particular, whether the user identification will be used for her-/himself or for third persons.

2. Performances by STATISTICS AUSTRIA

The participant capacity authorizes the participant to use the ISIS database online (data retrieval and data evaluation).

STATISTICS AUSTRIA may adapt the scope of performances as well as the rates charged to changed conditions. STATISTICS AUSTRIA undertakes to communicate any such alterations to the participant at least two months before the new conditions take effect.

Temporary or lasting restrictions of the data or functional range (due to barred main or sub-banks or segments, changes in the structural depth of the data supplied, restricted availability of arithmetical functions or utter breaks of operation) justify no claims by the participant on STATISTICS AUSTRIA.

3. Use of ISIS data

ISIS and the included data are protected by copyright. All rights are reserved by STATISTICS AUSTRIA. It is also prohibited to place the data into the Internet without prior written approval, even in case of free distribution. Further use (- even in extracts -) is permitted stating the correct source “ISIS Database of STATISTICS AUSTRIA".

Data are intended for the exclusive use of participants or third persons for whom user IDs have been issued. A participant issuing user IDs for third persons is obliged to have the above user regulations concerning ISIS data acknowledged in writing, and he/she is responsible to STATISTICS AUSTRIA for the adherence to the above user regulations by these third persons.

A commercial use of data is admissible only by the participant for whom the user identification has been issued.

Kinds of use

• no commercial use 
  the charges declared apply;
• single commercial use 
  passing on of data (processed or unprocessed) to one client only, an extra charge of 100 per cent is added to the charges declared;
• multiple commercial uses 
  stand for the circulation of the same data (processed or unprocessed) to several clients or for the offer of these data to an indefinite group of persons. An extra charge of 400 per cent is added to the charges declared.

4. Charges

The participant owes charges to STATISTICS AUSTRIA for its services according to the respective list of ISIS database charges in effect. The participant settles the accounts sent out by STATISTICS AUSTRIA quarterly by bank transfer to the specified account of STATISTICS AUSTRIA.

5. Right to appeal

The participant waives the claim to appeal against user charges on the grounds that the data retrieved were not useful for the purposes of the participant, that the inquiry dialogue could not be terminated correctly or that the query was performed by unauthorized persons.

6. Disclaimer

STATISTICS AUSTRIA does not guarantee for the correctness or completeness of the data supplied nor for mistakes, faults or losses caused by the incorrect handling by a participant. 

7. Validity and cancellation/cancellation of user identifications

User identifications are issued for an indefinite period of time. A written cancellation is possible at any time. In case of a renewed conclusion of contract STATISTICS AUSTRIA reserves the right to make modifications in the terms of participation (e.g., by increasing extra charges).

In case of gross violation of participation terms, particularly in the event of non-payment of the required amount within the term stated in the invoice and in case of infringement of the clause "Use of ISIS data" STATISTICS AUSTRIA is entitled to cancel the user identification of a participant without previous notice. The user identification may also be cancelled without previous notice if the participant has been adjudged bankrupt.

8. Jurisdiction

Place of jurisdiction is Vienna.
